It represents a considerable source of revenue and directly affects the artistic heritage of any songwriter. Yet, many turn their backs on it, or do not give it the attention it deserves. They sign away their rights without understanding why!<\/p>\n<p>In order to shed light on music publishing and its importance, I will be offering an overview in two separate articles. The first article will cover the basics, and the <a href=\"http:\/\/utopsie.com\/work\/menonb\/contrat-d-edition-partie-2-types-de-contrats-clauses-contractuelles-cle\/?lang=en\">second<\/a> will focus on some of the provisions you should look out for in your agreement.<\/p>\n<p>** [As this article is denser than usual, make sure you understand the terms <a href=\"http:\/\/utopsie.com\/work\/menonb\/6-termes-a-maitriser-mieux-comprendre-droits-musicaux\/?lang=en\">musical work<\/a>, <a href=\"http:\/\/utopsie.com\/work\/menonb\/droit-dauteur-quelques-notions-de-base\/?lang=en\">copyright<\/a>, <a href=\"http:\/\/utopsie.com\/work\/menonb\/6-termes-a-maitriser-mieux-comprendre-droits-musicaux\/?lang=en\">songwriter<\/a> and <a href=\"http:\/\/utopsie.com\/work\/menonb\/6-termes-a-maitriser-mieux-comprendre-droits-musicaux\/?lang=en\">composer<\/a> before reading!]<\/p>\n<h3><strong>WHAT PUBLISHERS DO<\/strong><\/h3>\n<p>First, let\u2019s make something clear: music publishing is a career. A very old career at that. As old as the existence of copyright.<\/p>\n<p>While many individuals or companies have developed a legitimate expertise in publishing, many claim the title without having the knowledge or skills: authors\/composers, beware!<\/p>\n<p>In short, the publisher is the manager of the musical work. In the same way that an actual manager will invest his energy in the development of the artist&#8217;s career, the publisher will invest his energy in the development of the musical work.<\/p>\n<p>As the owner of all or part of the rights to the musical work, the publisher\u2019s objective is to ensure the durability of the work&#8230; and obviously, to make money.<\/p>\n<p>The publisher&#8217;s areas of expertise can include the following:<\/p>\n<ul>\n<li><strong>creative<\/strong> [for example, the publisher can pair an author (lyrics) with a composer (music), or a songwriter with a performer, or forward an advance to the songwriter so that they can create the work, or actively participate in the creative process];<\/li>\n<li><strong>promotional<\/strong> [for example, the publisher can advertise the work for prospective performers or companies seeking music for their projects (films, commercials, video games, etc.)]; or<\/li>\n<li><strong>administrative<\/strong> [for example, the publisher will register the musical work with collecting societies, set the price of user licenses, and collect the income generated by the exploitation of the work].<\/li>\n<\/ul>\n<p>Bref, l\u2019importance de l\u2019\u00e9diteur est ind\u00e9niable, pour autant qu\u2019il soit choisi avec pr\u00e9caution!<\/p>\n<h3><strong>LE CONTRAT D\u2019\u00c9DITION&nbsp;: QU\u2019EST-CE QUE CELA VISE?<\/strong><\/h3>\n<p>L\u2019\u00e9dition musicale vise principalement les concepts d\u2019\u0153uvre musicale, de droit d\u2019auteur, d\u2019auteur et d\u2019\u00e9diteur.<\/p>\n<p>Le contrat d\u2019\u00e9dition est donc g\u00e9n\u00e9ralement celui par lequel l\u2019auteur c\u00e8de tout ou partie de ses droits d\u2019auteur sur l\u2019\u0153uvre musicale \u00e0 l\u2019\u00e9diteur, lequel s\u2019engage \u00e0 en assurer l\u2019exploitation et la protection ainsi qu\u2019\u00e0 verser une partie des revenus en d\u00e9coulant \u00e0 l\u2019auteur. [Il existe diff\u00e9rents type de contrats d\u2019\u00e9dition, j\u2019en ferai un survol dans la PARTIE 2]<\/p>\n<p><strong>** RAPPEL IMPORTANT&nbsp;**<\/strong> Certains contrats d\u2019\u00e9dition ont pour effet de transf\u00e9rer les droits de l\u2019auteur \u00e0 l\u2019\u00e9diteur&nbsp;: l\u2019auteur <strong>n\u2019a plus<\/strong> de droits d\u2019auteur sur son \u0153uvre, mais conserve son droit d\u2019en percevoir une partie des revenus.<\/p>\n<p>D\u2019o\u00f9 l\u2019importance de bien choisir, encore une fois.<\/p>\n<h3><strong>PUBLISHING ROYALTIES<\/strong><\/h3>\n<p>Generally speaking, the income generated from the usage of a musical work is split into two categories: the <em>writer\u2019s share<\/em> and the <em>publisher\u2019s share<\/em>.<\/p>\n<p>The standard rule is that the songwriter&#8217;s share must never be less than 50%. In other words, the songwriter never receives less than 50% of the income from the musical work.<\/p>\n<p>When a work is created, the songwriter owns 100% of the copyright, including the publishing royalties \u2013 the writer\u2019s share AND the publisher\u2019s share.<\/p>\n<p>However, in practice, when the songwriter signs a publishing contract, they generally assign to the publisher all or part of their copyright in the musical work. The publisher will then exercise all the rights reserved to songwriters from that moment on&#8230; and will collect their <em>publisher\u2019s share<\/em> according to the percentage established in the contract.<\/p>\n<p>For example, if it is agreed that the publisher collects 100% of the <em>publisher\u2019s share<\/em>, that means they get 50% of the total publishing royalties derived from the musical work. If the publisher collects half of the publisher\u2019s share (and the songwriter keeps the other half, for instance), that means the publisher will receive 25% of the total royalties derived from the musical work. etc.<\/p>\n<p>In short, the <em>publisher\u2019s share<\/em> is a question of money, not to ownership of the musical work: the publisher might hold 100% of the copyright in a musical work in a publishing agreement, but they will always only be entitled to the <em>publisher\u2019s share<\/em>, i.e. a maximum of 50% of the income from the usage and exploitation of the work.<\/p>\n<p>________________________________________________________________________________<\/p>\n<p>* THIS IS A BRIEF OVERVIEW OF THE VAST FIELD OF PUBLISHING.
